Terms of Service

Who we are

WhatToDo is operated by Potomac Digital Studio LLC, a Maryland limited liability company ("we," "us," or "our"). The app is available at whattodotoday.app and on the Apple App Store.

Acceptance of terms

By downloading, installing, or using WhatToDo, you agree to be bound by these Terms of Service. If you do not agree, do not use the app. These terms apply to all users of the app, including beta testers via TestFlight.

Beta disclaimer

Age requirements

• You must be at least 13 years old to use WhatToDo.
• Some suggestions may include venues with age restrictions (bars, nightlife, etc.). It is your responsibility to verify age requirements before visiting.
• Parents or guardians are responsible for supervising minors using the app.

AI-generated suggestions — important disclaimer

Specifically:

• Restaurant hours, availability, and pricing may have changed since AI data was generated.
• Event dates, ticket availability, and venue details must be verified directly with the venue or ticketing provider.
• WhatToDo does not guarantee that any suggested venue is open, available, or suitable for your group's needs.
• Always confirm reservations, tickets, and bookings directly through the third-party booking service.

Third-party services

WhatToDo may provide links to third-party services including Apple Maps, Google Calendar, Apple Calendar, and in the future, booking and ticketing platforms. These services are independent of WhatToDo. We are not responsible for:

• The accuracy of information on third-party platforms
• Transactions, bookings, or purchases made through third-party services
• The privacy practices of third-party services
• Any disputes arising from third-party bookings

Acceptable use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to reverse engineer, hack, or exploit the app or its APIs
• Use automated bots or scripts to interact with the app
• Create groups or sessions for the purpose of harassment or abuse
• Attempt to access other users' data
• Circumvent rate limits or security measures
• Share invite codes or session links with the intent to spam, harass, or disrupt groups

Intellectual property

The WhatToDo name, logo, app design, and all associated intellectual property are owned by Potomac Digital Studio LLC. You may not use, copy, or reproduce any part of WhatToDo without written permission. User-generated content (group names, session names) remains your own.

Disclaimer of warranties

WhatToDo is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy of AI-generated suggestions.

Limitation of liability

To the maximum extent permitted by law, Potomac Digital Studio LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of WhatToDo, including but not limited to:

• Reliance on AI-generated suggestions that turn out to be inaccurate
• Issues arising from third-party bookings
• Data loss resulting from app malfunction
• Any personal injury or property damage connected to activities suggested by the app

Indemnification

You agree to indemnify and hold harmless Potomac Digital Studio LLC from any claims, damages, or expenses arising from your use of WhatToDo or your violation of these terms.

Governing law

These terms are governed by the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Montgomery County, Maryland.

Changes to these terms

We may update these terms at any time. We will notify you through the app when material changes are made. Continued use of the app after changes constitutes acceptance of the new terms.

Termination

We reserve the right to terminate or suspend access to WhatToDo at any time, for any reason, including violation of these terms. Upon termination, your right to use the app ceases immediately.
